Keltie says that preventing “lookalike” goods is a real issue at the moment for brand owners. One potential strategy to consider is an IP asset knowns as Registered design protection. This is one of the quickest ways to obtain protection for fashion items providing they hold a sufficient degree of novelty and haven’t been disclosed. Having the correct procedures in place to identify creative rights and protect them will set a business on a sensible path. This can start with the identification and assignment of copyright upon 2D creation, the noting of creation dates, obtaining and recognising unregistered protection or filing registered forms of protection i.e. trade marks, registered designs and/or patents.

Meet Eleni Mezulanik, Director and Chartered Trade Mark Attorney at Keltie

Eleni deals with due diligence, filing and prosecution of trade mark applications around the world. She is also involved in copyright, design and company name matters. She has experience in clearance searching and preparing trade mark filing strategies, in addition to advising on registrability, infringement, passing off and the validity of trade marks. Eleni deals with contentious matters including filing and defending opposition, invalidation and revocation actions. She has experience in brand protection over a range of industries, particularly, luxury goods, gaming, retail, fashion, oil, automotive, food and drink sectors. Eleni is also a regular contributor to the CITMA Review.

Eleni graduated from the University of Kent with an Honours degree in Law in 2008 before completing the Bar Vocational Course at the College of Law in London. Subsequently, she was called to the Bars of England and Wales and the Bahamas. In 2010, Eleni obtained a Masters degree in IP law from Queen Mary, University of London.

Eleni joined Keltie in 2013 from a specialist IP law firm. There, she assisted with IP matters relating to domain names, company names, website content, trading names, counterfeit goods and auction websites. Eleni was involved with cases concerning IP dispute resolution, trade mark infringement, passing-off and parallel imports. Eleni is also appointed as a member of the MARQUES Intellectual Asset Management Committee.
